TBI from Trucking Accident

A 32-year-old man was involved in a trucking accident that caused him to suffer a tbi (traumatic brain injury). The driver of the tractor trailer accepted liability for the crash.

The primary issue in resolving this case was the extent and seriousness of the injuries and damages the TBI from Trucking Accidentplaintiff suffered in this trucking accident. The plaintiff had several serious injuries:

  • Multiple fractures of the sinus orbit
  • Subarachnoid and subdural hemorrhages
  • TBI

The plaintiff was unable to work for one year while recovering from his injuries. He returned to work, but sustained some permanent losses and harms. He lost his sense of smell (permanently). He was left with some deficits in executive function. In addition, encephalomalacia was identified in the frontal lobe of the brain. Plaintiff made a remarkable recovery despite his injuries and permanent deficits.

The plaintiff’s legal team worked with focus groups consisting of three groups of jurors in order to understand the financial value of the plaintiff’s case. Several illustrations of the plaintiff’s injuries were shown to the focus groups. Members of the groups reported that the illustrations were helpful to them. The illustrations enabled them to comprehend the extent of the injuries suffered by the plaintiff. Members of the focus groups also found the illustrations helpful in understanding the basis of some permanent effects of the injuries he sustained in the crash.

The focus groups were also shown video clips of the plaintiff and his wife. Members of the focus groups indicated that they found the individuals to be “strong, credible, and compelling witnesses.”

The plaintiff’s medical expenses for injuries sustained in this trucking accident to the time of mediation totaled $314,456. He reported lost wages of $54,432. A life care plan was prepared, with future care costs of $357,223.

Negotiations resulted in a $4,000,000 settlement to the plaintiff.

In understanding any trucking accident or vehicle crash it is important to keep in mind that a number of injuries do not manifest immediately. Instead, they emerge over several weeks or months. Other injuries may be immediately apparent but seem minor. These injuries may become worse over time.

Traumatic brain injury can result from trucking accidents or any vehicle crashes, as well as other personal injuries. It is important to understand that each TBI is unique. It is not uncommon for symptoms and effects of TBI to emerge over a period of weeks or months. Often, the permanent effects of TBI can be appreciated only after a time of healing.
