Mycobacterial Infection in Both Legs; Personal Injury Case Verdict $1,003,537
A woman entered a Henrico County nail salon business, asked for and received a pedicure. The pedicure also caused a serious infection.
This plaintiff developed an infection in both legs that was marked by painful boils and lesions shortly after the pedicure. She visited her physician, who diagnosed the symptoms as a very rare mycobacterial infection. The doctor further concluded that the infection probably resulted from unsanitary conditions and unclean tools.
Plaintiff was treated for the infection, including a number of surgical procedures to remove the infection from her legs. The infection and the treatment of the infection caused permanent scarring.
Conditions in the nail salon were reported and investigated by the Virginia Board of Barbers and Cosmetology. The nail salon’s license was revoked for the salon employees’ failure to follow recognized sanitation standards.
Plaintiff and her attorneys filed a personal injury suit. When the case was tried in court, the salon owner admitted that she and her staff did not follow industry sanitation guidelines. The salon owner also admitted failure to follow manufacturer recommendations and procedures when cleaning and sanitizing pedicure tools and basins both between customers and at the end of the work day.
The court verdict in this case was financial compensation for the plaintiff in the amount of $1,003,537.
When visiting a nail salon for a pedicure or manicure, if it is not your customary salon, take some time to look around the salon before the pedicure begins. If tools and surroundings do not appear to be sanitary, take time to consider your personal health and safety. If you believe the conditions and tools do not meet sanitation standards, it might be wise to go to another salon.
