Simple logic recognizes that when a delivery truck hits a motorcycle the motorcycle loses. Not only are motorcycles significantly smaller than most delivery trucks, but they remain upright only when the motorcyclist maintain proper balance. Thus, they are likely to be pushed onto their side when there is a crash. Despite available safety equipment, a motorcyclist is relatively unprotected in the event of a motorcycle accident. The larger and heavier the vehicle that crashes into a motorcycle the greater the harm is likely to be – to the bike and to the rider.
A few years ago, the driver of a delivery truck owned by a local transportation company collided with a motorcyclist when the driver failed to stop at a stop sign before making a right turn. When the driver of the delivery truck made the turn, he pulled onto the road directly in the path of the motorcycle driven by the plaintiff in this case. The motorcyclist did not have enough time/space to avoid a crash with the truck. In this crash, a delivery truck hit a motorcycle and the motorcycle and the motorcyclist lost.
When police arrived on the scene of the motorcycle accident, they charged the driver of the truck for failure to stop at a stop sign and for failure to yield the right of way to oncoming traffic. Medical rescue personnel evaluated the motorcyclist at the site and transported her to a local community hospital by ambulance. Later in the same day, she was transferred by a medical helicopter to a larger medical center, where she underwent surgery for her injuries.
The plaintiff (motorcyclist) sustained several injuries. There were multiple fractures of the right tibia and fibula. Treatment of these injuries required five surgical procedures, as well as skin grafts. After her release from the hospital, the plaintiff required round-the-clock care for eight full months. After treatment the plaintiff was left with permanent disability. In a short time, she was forced to resign from her job with the local County Public School system.
This case was resolved by the parties and their legal counsel before the suit was actually filed. The amount of the settlement for the plaintiff was $1,350,000.
